Reminder: The Tertiary Decree requires a progressive reduction of final energy consumption in tertiary-use buildings of ≥ 1000 m², with an annual declaration on the OPERAT (ADEME) platform.
  1. Does your site include one or more buildings or parts of buildings used for tertiary activities totaling ≥ 1000 m²?
    Main eligibility threshold.
  2. Are you the owner, landlord, or occupant responsible for energy usage?
    Responsibility may be shared between owner and occupant.
  3. Have you defined your reference year (between 2010 and 2019) and justified any modulation if needed?
    Reference for calculating -40% (2030), -50% (2040), -60% (2050) targets.
  4. Are your energy consumption data (electricity, gas, others) collected and verified annually?
    Sub-metering by use and building is recommended.
  5. Have you completed your OPERAT declaration (site/building creation, reference year, annual consumption)?
    OPERAT issues an annual compliance certificate.
  6. Have you formalized an action plan (works, operations, usage) to meet the -40% target by 2030?
    Includes operational gains, envelope/HVAC works, and behavioral changes.
  7. Do you have a periodic monitoring (monthly/quarterly) of energy indicators per use/site?
    Helps detect drifts and feeds the OPERAT system.
  8. Have you addressed specific usage constraints (extended schedule, processes, density) and prepared modulation requests if needed?
    Modulations adjust targets in case of constraints.
  9. Are the roles and responsibilities (owner/tenant/operator) contractually defined for Tertiary Decree obligations?
    Prevents conflict over works, data access, and responsibilities.
  10. Have you planned deadlines (annual data collection, OPERAT declaration, 2030/2040/2050 goals) and risks (sanctions/display)?
    Planning reduces legal and reputational risks.
